Commissioner for Oaths
A Commissioner for Oaths is appointed by the Chief Justice under the Commissioners for Oaths Rules 2018 [P.U. (A) 67], made under subsection 11(2) of the Courts of Judicature Act 1964. The appointment falls under civil jurisdiction and is separate from admission as a Syarie lawyer. The duty of a Commissioner for Oaths is to verify the deponent's identity, read out and explain the contents of the document, and witness the signature. It is important to understand this: a Commissioner for Oaths does NOT certify that the contents of the document are true — responsibility for the truth of the facts remains with the person making the declaration. Fees are charged at the statutory rates set out in the Second Schedule to those Rules, not at rates set by the firm.
